1. Who we are and what these terms cover
Conquer ("Conquer", "we", "us", "our") is a gamified mountain‑hiking application that lets you discover, plan and record peak ascents, build streaks, add friends and join group trips. The service is provided by:
Vegard Nygård
Damsgård 31C, 4318 Sandnes
Norway
Email: conquerapp@proton.me
These Terms of Service (the "Terms") are a binding legal agreement between you and us. They apply to:
- the Conquer mobile application for iOS and Android,
- the conquer.app website and any related online services we offer, and
- any Conquer Pro subscription you purchase through an in‑app store.
If you do not agree to these Terms, do not use Conquer.
2. Acceptance and changes to these terms
You accept these Terms by creating an account, signing in, or using any part of Conquer. If you use Conquer on behalf of an organisation (for example a hiking club), you accept these Terms on behalf of that organisation and confirm you have authority to do so.
We may change these Terms from time to time. If we make a material change (for example, changing what your subscription includes, or your statutory rights), we will:
- give you at least 30 days' notice by email and in‑app banner,
- show you the new Terms on next sign‑in and ask you to confirm them, and
- let you cancel your subscription and delete your account before the change takes effect if you do not agree.
Non‑material changes (for example, fixing typos or clarifying an existing rule) take effect immediately and are reflected by an updated "Last updated" date at the top of this document.
3. Eligibility, accounts and your handle
Minimum age. You must be at least 13 years old to use Conquer. If you are under 16 (or the digital‑consent age in your country, whichever is higher), you may only use Conquer with the consent of a parent or legal guardian. We do not knowingly collect personal data from children under 13.
Account integrity. You are responsible for keeping your sign‑in credentials confidential and for everything that happens under your account. Tell us immediately if you suspect someone else has accessed your account.
Your handle. You must pick a handle (username) to use friend, chat and social features. Handles must be 3–20 characters using letters, digits or underscore. We may reclaim handles that:
- impersonate a real person, organisation, public figure or our brand,
- contain hate speech, harassment, sexual content or threats,
- are inactive for more than 12 months and are requested by a verified rights‑holder, or
- otherwise violate these Terms.
One person, one primary account. You may not create accounts to evade a suspension, to inflate leaderboards, or to harvest referral rewards. We may detect and merge or remove duplicate accounts.
4. The service in plain language
Conquer helps you:
- Discover mountains catalogued in the app and plan ascents.
- Log a conquest by reaching the summit while the app records your GPS trail and (where supported) barometric pressure.
- Earn points, build streaks and unlock achievements based on your conquests.
- Add friends, send direct messages, join groups and compare on leaderboards.
- Upload one summit photo per peak you conquer.
The service is provided as‑is. Features may change, be added or be removed (see Section 14). Free features may become paid, and paid features may move to the free tier, at our discretion.
5. Subscriptions, free trials, billing and cancellation
5.1 What Conquer Pro is
Conquer Pro is our optional paid subscription. It currently includes:
- Pro avatar frames and aesthetic touches.
- Advanced analytics (pace splits, vertical‑gain trends, leaderboard wins, county breakdown).
- Friend stats to see friends' full stats and compare head‑to‑head.
- Custom lists to organise peaks your own way.
- Offline maps for downloaded regions or peaks.
- Safety beacon to share a live tracking link with a trusted contact.
The exact list of Pro features may change. If we remove a Pro feature, we will give you 30 days' notice and a pro‑rata refund or credit if the change materially reduces what you paid for.
5.2 How you buy Pro
Pro is sold as an auto‑renewing yearly subscription through the Apple App Store (and, in the future, Google Play). Your subscription is purchased from, billed by, and managed through that store under its own terms — not directly from us. The price you see in the paywall is the localised price returned by the store at that moment, in your store currency.
5.3 Free trial
When available, we offer a 1‑week free trial to new subscribers. The following rules apply:
- The trial is limited to one per Apple ID (or Google account). The store, not us, determines whether you qualify.
- During the trial you have full access to Pro features.
- Your subscription auto‑renews into a paid year at the end of the trial unless you cancel at least 24 hours before the trial ends.
- Cancellation is done through your store account settings; we cannot cancel a store subscription for you.
- If you cancel during the trial, you keep Pro access until the trial period ends and are not charged.
5.4 Auto‑renewal and price changes
Pro auto‑renews each year at the then‑current price until you cancel. The store may notify you ahead of any price change. If the price increases by more than the rate of inflation, you must consent to the new price for the subscription to continue.
5.5 Refunds
Refund requests are handled by Apple or Google, not by us. To request a refund:
- Apple: reportaproblem.apple.com
- Google: in the Google Play app, tap your profile → Payments & subscriptions → Budget & history → request a refund.
Where Norwegian or EU/EEA consumer law gives you a stronger right (for example, Section 22), that right applies in addition to the store's policy.
5.6 Referral rewards interact with Pro
You can earn free Pro time by inviting friends who go on to log their first summit. The cap and reward per referral are shown in the in‑app friends screen. Referral weeks are credited to your account directly and are not refundable as cash. They cannot be transferred or stacked on top of an already‑active Apple/Google subscription period (your store subscription continues unaffected; referral weeks queue until your store subscription ends).
6. Your content and the licence you grant us
"Your Content" means everything you upload, post or transmit through Conquer — including summit photos, side‑quest photos, display name, handle, direct messages, group messages, conquest notes and any other text or media you provide.
You keep ownership of Your Content. You grant us a worldwide, non‑exclusive, royalty‑free, sub‑licensable licence to host, copy, transmit, display, resize and adapt Your Content for the purpose of operating, improving and securing the service and for the audiences you have chosen (e.g. your friends, a group, or public peak galleries when you opt in).
This licence:
- ends when you delete the content or your account, except for backups retained for a reasonable period for backup, audit or legal reasons;
- does not grant us the right to sell Your Content separately from the service or to use it for advertising outside the service without your consent;
- does not apply to direct messages or private group chats beyond what is needed to deliver them, moderate abuse and comply with the law.
You represent and warrant that you own or have the rights to upload Your Content and that it does not infringe anyone else's rights, contain unlawful material or otherwise violate these Terms.
Photos on peak pages. When you add a summit or trail photo to a peak you have climbed, a toggle shown at upload lets you choose whether that photo is shown on that peak's public page inside Conquer for other members to see. Your choice is remembered for your next upload and you can change it at any time. If you turn it off, the photo stays on your own conquest log and is not shown publicly. Photos you choose to show publicly may be displayed, resized, ordered and filtered — including automatically — to assemble each peak's gallery; turning the choice off for a future upload, or deleting the photo, removes it from the public gallery.
7. Acceptable use and prohibited conduct
You agree not to use Conquer to:
- break any law, regulation or third‑party right;
- impersonate any person, falsify your identity, or misrepresent your affiliation with anyone;
- upload sexual content, gore, hate speech, harassment, threats or content that targets a person or group on the basis of a protected characteristic;
- upload photos of identifiable people without their consent, except where law plainly permits (e.g. public events at a recognisable distance);
- fake GPS, spoof your location, manipulate the barometer, edit photo metadata, or otherwise submit a conquest you did not actually complete;
- scrape, mass‑download, mirror or otherwise extract data from Conquer except via features we expose for that purpose;
- reverse engineer, decompile or disassemble the app except where local law permits and only to the extent necessary;
- introduce malware, viruses, harmful code or tooling, run denial‑of‑service attacks, or probe for vulnerabilities without our written permission;
- resell access, sub‑license, white‑label or otherwise commercialise the service without our written permission;
- use the service for surveillance, doxxing, or to stalk, harass or threaten any person;
- abuse referral, leaderboard, achievement or photo‑bounty mechanics — including coordinated voting rings, sockpuppet accounts or trading rewards for off‑platform consideration;
- interfere with the operation of the service, including poll loops, automation, bots or any client other than the official Conquer apps.
We may remove content, suspend accounts and refuse service for any breach of this Section. Severe or repeated violations may be referred to law enforcement.
8. Friends, messages and group features
Direct messages are visible only to you and the recipient. Group messages are visible to members of that group. Neither is end‑to‑end encrypted; we can access message content where strictly necessary to operate the service, respond to a valid legal request, or investigate abuse. We do not mine private messages for advertising.
You may block a user at any time. Blocking severs the friendship, hides their messages and invites, and prevents either of you from re‑adding the other until you unblock.
You may leave a group at any time. If you are the group owner, the longest‑tenured member automatically becomes the new owner. We may delete groups that are empty, inactive for a long period, or in violation of these Terms.
9. Safety on the mountain — your responsibility
Conquer does not make any mountain safer. You — and only you — are responsible for deciding whether to attempt a peak, which route to take, when to turn around, and what gear, training and companions you bring.
In particular, you agree that:
- Routes shown in Conquer are sourced from public OpenStreetMap and Kartverket data. They may be inaccurate, out of date, dangerous in current conditions, on private land, or otherwise unsuitable for you.
- Weather forecasts and other environmental data shown in Conquer are third‑party estimates. They are not a substitute for checking official sources (yr.no, the Norwegian Avalanche Warning Service / varsom.no, local mountain reports) and using your own judgement.
- GPS verification of a summit does not mean the climb was safe — it only means your phone reported coordinates consistent with the peak's recorded position.
- Trailheads, parking, huts and stations shown in the app may be closed, full, on private property, or in unsafe condition.
- Mobile coverage, battery life and device sensors can fail at any time. Do not rely on Conquer as your only navigation, location or emergency tool. Carry a map, compass, charged headlamp and any other equipment appropriate to the climb. In Norway, register an emergency plan and contact, and know the 112 emergency number.
- The "Safety beacon" Pro feature is a convenience, not a guaranteed emergency response system. It depends on cellular coverage, third‑ party push delivery, and your trusted contact actively monitoring the link. It does not replace registering a real emergency plan or calling emergency services.
- Your safety contacts are people, and you are responsible for adding them. Before you save someone as a safety contact, make sure they have agreed to it and know what it means: we will store their name and contact details and send them SMS, email or push alerts on your behalf — containing your name, the peak, your last known coordinates and a link to your live tracking page. You confirm that you have their permission, and that the details you enter are correct and belong to a person who is willing to be contacted. We use their details for nothing except delivering those alerts (see the Privacy Policy, section 5).
- A tracking link is public to whoever holds it. Anyone you send it to can open it without an account, and can pass it on. Share it only with people you trust.
By using Conquer you accept the risks of mountain travel. You release us from any claim arising from your decision to attempt or complete any ascent, to the maximum extent allowed by law.
10. Privacy and personal data
How we collect, use, share and protect your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. If any provision in these Terms conflicts with the Privacy Policy on a matter the Privacy Policy specifically governs, the Privacy Policy controls.
11. Intellectual property
The Conquer name, logo, design, source code, app artwork, illustrations, sounds, mascots and the overall look and feel of the service are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws.
We grant you a personal, limited, non‑exclusive, non‑transferable, revocable licence to use the Conquer apps and website to access the service for your own non‑commercial use, subject to these Terms.
You receive no other rights to our brand, code or content. In particular, you may not:
- copy, modify, distribute, sell, lease or publicly display any part of the service except as expressly permitted in‑app (for example, sharing a summit card we generated for you);
- remove or alter any copyright, trademark or attribution notice;
- use our content to train, fine‑tune or evaluate any machine‑learning model without our prior written permission.
If you believe content on Conquer infringes your copyright, send a notice to conquerapp@proton.me including the work allegedly infringed, the URL or in‑app location, your contact details, and a statement of good faith and accuracy. We act on substantiated notices and may forward them to the user who uploaded the content.
12. Trademarks and brand
"Conquer", the Conquer mountain glyph and our other logos are our unregistered trademarks (where not registered) or registered trademarks (where registered). You may not use them in your own product, store listing, marketing material or domain name without our written consent.
You may refer to Conquer in editorial contexts (news articles, reviews, blog posts about your hike) without prior consent, provided you do so truthfully and in a way that does not suggest endorsement or sponsorship by us.
13. Suspension, termination and deletion
You can leave at any time. You may delete your account from the in‑app Settings → Account → Delete account screen. Account deletion removes your personal data as described in the Privacy Policy. Summit photos you have uploaded are deleted; aggregated, anonymous statistics (for example, "this peak has been summited 1,743 times") may remain.
We may suspend or terminate your access — temporarily or permanently — if we reasonably believe:
- you have materially or repeatedly breached these Terms,
- you have engaged in fraud, payment chargebacks or referral abuse,
- your account is being used to harass, stalk or harm another user,
- continuing to provide service would expose us to legal risk or to significant cost we did not agree to bear, or
- a public authority lawfully requires us to act.
Except where doing so would interfere with an investigation or violate law, we will notify you and give you a reasonable chance to fix the issue before terminating. On termination:
- you lose access to the service and to any unused Pro time we issued directly (for example, referral weeks); store‑sold subscription days already paid for are managed by Apple/Google;
- you remain liable for amounts owed up to the date of termination;
- sections that by their nature should survive (sections 6, 11–12, 15–20, 25–26) continue.
14. Changes to the service
We may add, change, retire or remove features at any time without notice. We will give reasonable advance notice — at least 30 days where feasible — when a change:
- removes a paid feature you currently pay for,
- deletes content you have uploaded, or
- reduces a statutory right you have under EU/EEA consumer law.
We may take the service offline for maintenance, updates or emergencies. We try to do so during low‑traffic windows.
15. Disclaimers
To the maximum extent permitted by law:
- The service is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error‑free, secure, free of malicious code, or that any data you upload will not be lost.
- We make no warranty about the accuracy, completeness or suitability of any peak data, route, trailhead, parking lot, weather forecast, elevation, difficulty rating, leaderboard, photo, achievement or other information shown in the service.
- We make no warranty that summit verification will be accepted by any third party (insurer, employer, club, tourist board, etc.) as proof of ascent.
- We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non‑infringement, to the extent the law allows.
Nothing in this Section limits warranties or rights that cannot be excluded under the Norwegian Consumer Purchases Act (forbrukerkjøpsloven), the Norwegian Marketing Control Act (markedsføringsloven) or other mandatory consumer law that applies to you.
16. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost business, lost data, lost reputation, lost streaks or lost time, even if we were advised that such damages were possible.
- Our total aggregate liability to you for all claims arising out of or relating to the service in any twelve‑month period is limited to the **greater of (a) the amount you paid us for Conquer Pro in that twelve‑month period, or (b) NOK 1,500.
- We are not liable for any injury, illness, death, property damage or loss arising from your decision to attempt, continue or complete any climb or to follow any route, weather forecast, trailhead or other information shown in the service. Your decisions on the mountain are yours.
Nothing in this Section limits liability for:
- death or personal injury caused by our gross negligence or intentional wrongdoing;
- fraud or fraudulent misrepresentation;
- any other liability that cannot be excluded under applicable law.
If you are a consumer resident in the EU/EEA, this Section applies only to the extent permitted by the mandatory law of your country of residence.
17. Indemnity
You agree to defend, indemnify and hold us harmless from any third‑party claim, damage, loss or expense (including reasonable legal fees) arising from:
- Your Content,
- your breach of these Terms,
- your violation of any law or third‑party right, or
- your use of the service in a way that ignores the safety obligations in Section 9.
This does not apply to claims that arise from our own gross negligence, wilful misconduct, or breach of these Terms.
18. Third‑party services
Conquer integrates with third‑party services to provide certain features. These include:
- Apple App Store and Google Play — distribution and billing;
- Apple Sign in with Apple, Google Sign‑In — authentication;
- Mapbox — basemaps, tile delivery and the 3‑D terrain mesh;
- Kartverket and OpenStreetMap contributors — peak, route and trail data;
- Apple Push Notification service (APNs) and Firebase Cloud Messaging (FCM) — push delivery;
- Railway — server hosting;
- Cloudflare R2 — photo storage;
- MET Norway / yr.no — weather forecasts.
Your use of these services is subject to their own terms and privacy policies. We are not responsible for their availability, accuracy or practices, but we choose and configure them to support the features we offer.
19. Force majeure
We are not liable for any failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, fires, floods, epidemics, pandemics, government action, sanctions, war, terrorism, civil unrest, internet outages, denial‑of‑service attacks, power failures or strikes by third parties.
20. Governing law and venue
These Terms are governed by Norwegian law, without regard to its conflict‑of‑law principles.
If you are a consumer, the mandatory consumer‑protection law of your country of habitual residence applies in addition, where it gives you stronger rights, and you may also bring claims before the courts of that country.
Unless local consumer law says otherwise, any dispute that cannot be resolved informally will be brought before Sandnes tingrett (Sandnes District Court), Norway, as the agreed legal venue. If you are a consumer resident in the EU/EEA, you may also use the EU's Online Dispute Resolution platform at ec.europa.eu/consumers/odr or your country's consumer ombudsman.
21. Your statutory rights as an EU/EEA consumer
Nothing in these Terms removes or limits any right you have under mandatory consumer law in your country of residence, including:
- the Norwegian Consumer Purchases Act (forbrukerkjøpsloven),
- the Norwegian Cancellation Act (angrerettloven),
- the e‑Commerce Act (ehandelsloven),
- EU Consumer Rights Directive 2011/83/EU,
- EU Digital Content Directive 2019/770, and
- EU Sale of Goods Directive 2019/771.
Where any provision of these Terms conflicts with a non‑waivable statutory right, the statutory right prevails for that issue.
22. Right of withdrawal
If you are a consumer in the EU/EEA, you have the right to withdraw from a Pro subscription within 14 days of the day on which the contract was concluded, without giving any reason.
Important exception. When you start using Conquer Pro features during this 14‑day period (for example, by downloading an offline map, viewing a Pro analytics panel or sharing a safety‑beacon link), you expressly consent to the supply of digital content beginning before the withdrawal period expires, and you acknowledge that this causes your right of withdrawal to lapse. This is in line with §22(n) of the Norwegian Cancellation Act and Article 16(m) of the EU Consumer Rights Directive.
If your right of withdrawal still applies, contact us at conquerapp@proton.me within 14 days. We will refund the amount paid through the same channel you used to pay. Because the subscription is billed by Apple or Google, the actual refund is processed by them.
23. Apple App Store schedule
This Section applies only when you obtain or use the Conquer app through the Apple App Store. It is required by Apple's developer agreement. Where it conflicts with the rest of these Terms, this Section controls for App Store distribution issues.
- These Terms are concluded between you and us, not between you and Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
- The licence to use the app on a device running iOS / iPadOS is limited to use on a device you own or control, as permitted by the Apple Media Services Terms.
- Apple has no obligation to furnish any maintenance or support services with respect to the Conquer app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
- Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including product‑liability claims, claims that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
- In the event of any third‑party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, we — not Apple — will be solely responsible for investigation, defence, settlement and discharge of such claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third‑party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third‑party beneficiary.
24. Google Play schedule
This Section applies only when you obtain or use the Conquer app through the Google Play Store.
- These Terms are concluded between you and us, not between you and Google LLC or its affiliates ("Google").
- Your use of the app must comply with the Google Play Terms of Service.
- Google is not responsible for the app or its content.
- Where these Terms conflict with the Google Play Terms of Service for issues that Google Play specifically governs (for example, refunds processed by Google), the Google Play Terms of Service control for those issues.
25. Severability, assignment and entire agreement
Severability. If any provision of these Terms is held invalid or unenforceable, the rest of the Terms remain in effect, and the invalid provision is reformed only to the extent necessary to make it enforceable.
No waiver. Our failure to enforce a provision does not waive our right to enforce it later.
Assignment. You may not assign these Terms or any rights under them without our written consent. We may assign these Terms in connection with a merger, acquisition, sale of substantially all of our assets, or similar transaction, provided your rights are not materially reduced.
Entire agreement. These Terms, together with the Privacy Policy and any feature‑specific terms we publish in‑app, are the entire agreement between you and us about the service, and supersede any prior agreements.
Language. These Terms are written in English. We may provide translations for convenience, but the English version controls in the event of conflict.
